Kris' stalling on Kim split doesn't look legit

As if trying to ruin Kim Kardashian’s life by prolonging their marriage was not enough, Kris Humphries most likely will make her fetus end up born as an illegitimate child.

The former couple, heading to court on Feb. 15 to set a date for their divorce trial, likely won’t settle the case until June at the earliest â€" which means that when the child is born, Humphries will still legally be Kim’s husband.

The reality mogul, who’s wanted her 72-day hubby out of her shiny locks for over a year now, is devastated with the timing, but not enough to give in to Kris’ demand to admit the marriage was a sham.

“She would never,” says a source close to Kim. “She wants to end all ties with Kris ASAP!” Following Kanye West’s “baby mama” announcement Dec. 30 at Revel in Atlantic City, Kimye looked blissful on New Year’s Eve together with momager Kris Jenner at 10Ak club in Las Vegas.

Meanwhile, Humphries, who has been riding the bench as a Nets forward, is still demanding he get back the $ 2 million engagement ring he gave to Kim, which she refuses to do.

He’s also been yapping to friends about holding up the divorce, saying he’s “got all the power,” says a source close to Kris. “He brags to everyone that he has that power. He’s said it a million times,” says the source.

“They can’t go to court until his basketball season is over, so he tells people that he is in control of her misery. When he found out about the baby, he was bragging to all of his friends that he wasn’t going to ‘allow’ her to be divorced when she had the baby.

He intends to tell his attorney when they set a trial date next month that he can’t do it until late summer. It’s all planned and calculated.” A rep for Humphries declined comment for this story.

CHRIS BROWN THROWS IT OVER TO DRAKE

Chris Brown is blaming his nemesis Drake for the bottle throwing melee at a Manhattan nightclub last June, reports the Daily News’ Dareh Gregorian. Brown’s lawyer filed papers in Manhattan Supreme Court, saying Drake and club WiP should be held responsible for the notorious melee but “Don’t Judge Me” singer Brown and the people “under his control” had nothing to do with it.

Model Romain Julien had sued Brown, Drake and the club over a severed tendon in his hand. In Brown’s filing, he claims that “such injuries and/or damages would have been caused in whole or in part by defendants Aubrey Graham Drake [and] W.I.P. Club.”

Brown added that if turns out people from his “posse” or “entourage” were involved, it wasn’t at his direction. A rep for Drake, who’s denied any wrongdoing, did not return a call for comment. Brown’s lawyer did not return calls, and a rep for WIP declined comment.

VINNY IS MORE THAN TALK

“Jersey Shore’s” off, but Vinny Guadagnino’s girlfriend is back on. The reality star, who soon gets his own MTV talk show, “The Show With Vinny,” wasn’t shy with PDA as he planted one on gorgeous galpal Melanie Iglesias at Joonbug.com in front of the huge crowd at the AMC on 34th St. during a New Year’s bash. The theater had been turned into a huge club for the night.
